TERMS AND CONDITIONS
Please read these Terms & Conditions carefully before purchasing.
By purchasing tickets, completing a Booking Form or attending The Drive In event in any capacity including direct employment or contracting, you are agreeing to be bound by the following Terms & Conditions.
Conditions of Entry – The Drive In.
Gates open for vehicles from 1.30 hours prior to the screening time, e.g. 4.30pm for a 5.30pm start time.
Cars are required to be at the cinema 30 minutes before movie start time if they are not their admission is not guaranteed.
The Drive In does not guarantee entry to persons who have not booked for a specific session.
Upon purchasing a ticket to The Drive In, the purchaser agrees to be bound by the rules and regulations of the venue and The Drive In, as well as by the Liquor License that applies within the The Drive In site.
BYO alcohol is not permitted.
Patrons must remain within The Drive Ins permitted areas where instructed to do so by The Drive In’s staff or agents.
Open flames of any sort may not be bought into or used in the The Drive In site.
The Staff on duty at any given time during cinema operating hours reserve the right to refuse admission to any member of the public and if a person or persons are disturbing other customers they can be asked to leave the premises.
Safety & Security
All drivers are to follow the instructions of parking stewards and cinema staff at all times for their own safety and the safety of others attending.
Drive-In Cinema reserves the right to refuse the entry onto its premises of any person who is believed to be overly intoxicated and may require any person or customer who is believed to be overly intoxicated to leave the premises immediately without any entitlement to a refund.
No customer is allowed to bring any illegal substances or weapons onto the premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund. We take such matters seriously and may report any incident to the police.
If a customer wishes to leave during the showing of a movie they are to alert cinema staff and wait to be guided out by them from the premises.
Drive-In Cinema or any employees will not be liable or held responsible for any cars or vehicles of any kind that are damaged or have goods or items taken or stolen from them at the cinema premises, or for any vehicle collisions that may occur or injuries caused to any individual or person as a result of a collision.
All vehicle occupants must be eligible for the appropriate film rating and must provide valid ID if requested. We will refuse entry to anyone deemed underage for any screening without any entitlement to a refund.
1.0 Terms of Sale
1.1 Tickets sold by The Drive In are subject to the following terms and conditions:
1.2 All ticket sales are final and non-transferable. Refunds and exchanges will not be made for inadvertently booking the wrong session. Refunds will not be given for a cancellation or termination due to adverse weather conditions. Refunds will not be given for a cancellation or termination due to a decision by the host venue or other occurrence outside of The Drive In’s direct control or due to mechanical breakdown.
2.0 Alterations to the Event Day
2.1 The event day venues are outdoors. Therefore, no alternative facilities are available in the event of unfavourable weather.
2.2 If any part of the Event including, without limitation, any, screening, performance or event is cancelled, abandoned or postponed, in whole or in part, due to adverse weather or for any other reason whatsoever that is beyond The Drive In’s control, including, without limitation, by reason of fire, flood, earthquake or similar catastrophic event, state of emergency, Act of God, warlike hostilities, an Act of Parliament, regulation or direction or any strike or industrial action or epidemic, disruption to the power supply, or any cause not within the control of the Organisers, (together “Force Majeure Event”) then the Organisers shall not be liable in any way whatsoever for any expenditure of liability of loss, including consequential loss incurred by the Client. There is no right to refund or exchange and no obligation is assumed by The Drive In for the arrangement of a substitute event, performance or any other element.
2.3 Cancellation / Postponement Due To Adverse Weather: The Drive In is an outdoor event and is occasionally subject to adverse weather. We try to go ahead with screenings wherever possible, and do not cancel for light/intermittent/potential rain. We strongly recommend customers check their wipers before coming to the cinema. Screenings will be cancelled only if the weather poses a safety threat to patrons and staff. The decision to cancel a screening is made by the Venue Manager on site, and can be made at any time up to or during the screening, as weather conditions are notoriously unpredictable. Patrons accept the risk that weather they consider unsatisfactory may occur on a screening night and acknowledge that tickets will not be re-validated unless a screening is officially cancelled by The Drive In.
The Drive In does not provide refunds on tickets in the event of a cancellation / postponement due to Adverse Weather. If a session is cancelled due to adverse weather, tickets are automatically converted to a voucher redeemable for the same ticket type for a future session of The Drive In. You must retain your original tickets (vouchers) in order to re-use them on another night.
When a session is postponed, customers will receive an email to the email address entered when purchasing tickets online. The email will contain instructions on how to rebook for another session. Additionally, signage will be erected at the venue notifying customers of the cancellation.
In the event that a cancellation due to adverse weather occurs in the final week of the event, and a ticket holder is unable to attend another session during that season, ticket holders are invited to contact us quoting the session and booking reference code to receive complimentary tickets for the following season.
2.4 If a movie session is cancelled or terminated due to a decision by the host venue or other occurrence outside of The Drive Ins direct control, The Drive In will provide vouchers redeemable for the same ticket type for a future session during that The Drive In season at the venue for which the original tickets were purchased. Tickets are subject to capacity and entry is not guaranteed.
2.5 If a movie session is cancelled or terminated due to mechanical breakdown The Drive In will refund the face value of each ticket upon return to The Drive In of intact tickets to that session or will provide vouchers redeemable for the same ticket type for a future session during that The Drive In season at the venue for which the original tickets were purchased.
2.6 Staff working at The Drive In are not able to provide refunds.
2.7 Entry may be refused if tickets are damaged or defaced in any way or are not purchased from one of The Drive Ins authorised points of sale.
2.8 The Drive In reserves the right to charge patrons for the replacement of lost or damaged tickets.
2.9. GST will apply to all goods and services supplied through this site.
3.0 Privacy and access
3.1 Any personal information that The Drive In collects from your use of this web site will be maintained in accordance with The Drive Ins privacy policy.
3.2 The Drive In may refuse access to this web site at any time in its sole discretion.
4.0 Variation
4.1 The Drive In reserves the right to vary the terms of sale at any time. Variations become effective upon posting on the web site. By making a purchase through this site after the terms and conditions have been varied you agree to be bound by the variation.
4.5 Programmes, menus and the duration and timing of performances, events and other activities at the Event may be subject to alteration without notice. The Drive In reserves the right to vary, add, withdraw or substitute advertised programmes, menus, seating arrangements and/or facilities at any time.
General
5.1 All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law.
5.2 This contract is governed by and construed in accordance with New Zealand law and customers agree to submit to the exclusive jurisdiction of the courts of New Zealand.
